I was married by Muslim rites in Udaipur in July 2006. Is the registration of our marriage compulsory?
I am Muslim and I got married according to Muslim rites in Udaipur in July 2006. Is the registration of our marriage compulsory? If yes, how can I take? His was more than 9 months since the wedding is it too late for registration? What are the penalties / disadvantages for non-registration?
Yes, you can get your marriage registered at any time after the actual wedding ceremonies under the Special Law on Marriage, 1954. Under Article 15 of the Act, any form of marriage solemnized in any other form may be recorded under the following conditions (a) a ceremony of marriage was conducted between the parties and they lived together as husband and wife from (b) Neither party has at the time of registration of more than one spouse living, (c) Neither party is an idiot or insane at the time of registration: (d) The parties have reached the age of twenty-one year at the time of registration; (e) The parties are not in the degrees of prohibited relationship: Provided that in the case of a marriage celebrated before the coming into force this Act, that condition shall be subject to any law, custom or usage with the force of law governing each of them, which allows a marriage between two, and (f) The parties have resided in the district registrar for a period of not less than thirty days immediately preceding the date the request is made for registration of marriage. Article 16 of the Act provides the procedure for such registration receipt a request signed by both parties to the marriage for their registration under this chapter, the registrar shall give public notice thereof such manner as may be prescribed and after allowing a period of thirty days for objection and after hearing any objection received within that period, if satisfied that all conditions mentioned in art. 15 are met, enter a marriage certificate in the book of marriage certificate the form specified in the Fifth Schedule and such certificate shall be signed by the parties to the marriage and three witnesses. Now that the time away from the registration after the marriage in question is not listed here, you can get it registered at any time after the wedding itself, hence no penalties for late registration.
